The Auerswald ICT group has been successful in restructuring as a debtor in possession. LongTec Holding AG has acquired Auerswald’s operations by way of an asset deal effective 1 December 2025. Around 80 employees will be kept on. The Cremlingen site and the Auerswald brand will be maintained.

Management at Mocopinus GmbH & Co. KG has filed for the initiation of provisional debtor-in-possession insolvency proceedings with the Local Court of Ulm, as the competent insolvency court. The court has assented to the company’s application and ordered provisional debtor-in-possession proceedings. Mocopinus will continue operating during the proceedings under the supervision of attorney Mr Georg Jakob Stemshorn (PLUTA Rechtsanwalts GmbH) in his capacity as court-appointed provisional insolvency monitor. Management remains in charge, has full authority to act and is actively shaping the restructuring process.

MW GmbH has filed for insolvency. On 24 November 2025, the Local Court of Ingolstadt ordered provisional insolvency administration for the assets of the Ingolstadt-based mechanical engineering business and appointed Mr Daniel Barth from PLUTA Rechtsanwalts GmbH as provisional administrator.

Attorney Mr Christoph Chrobok from PLUTA Rechtsanwalts GmbH has achieved a good result in the insolvency proceedings for SRG - Schrottservice Ruhr GmbH (previously: Recuperma Service GmbH). KISA GmbH from Kamp-Lintfort has acquired the company’s assets. Individual employees have been offered new employment with KISA.

Caritasverband für das Dekanat Bocholt e.V. (‘CV Bocholt’ for short) filed for provisional debtor-in-possession proceedings yesterday with the Local Court of Münster (as the competent court), which has already approved the application. During these proceedings, the association’s president will retain operational responsibility and all authority to act and issue instructions.

On 17 November 2025, Wilhelm Weber GmbH & Co. KG filed for debtor-in-possession insolvency with the Local Court of Esslingen, as the competent insolvency court. Dr Sebastian Mielke, a partner with Menold Bezler, has been named restructuring officer. The court has appointed attorney Mr Steffen Beck from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor. He will monitor the proceedings while representing the interests of creditors.

Ketteler Krankenhaus gemeinnützige GmbH has initiated in-court restructuring proceedings as a debtor in possession to equip itself for the future. The aim of the proceedings is to ensure the hospital’s long-term financial stability and sustainably improve the provision of medical services in Offenbach. The Local Court of Offenbach has approved the application and ordered provisional debtor-in-possession proceedings.

The association Familienferiendorf Hübingen e.V. has filed for insolvency. On 30 October 2025, the Local Court of Montabaur ordered provisional insolvency administration for the association’s assets. Mr Philip Konen from PLUTA Rechtsanwalts GmbH has been appointed provisional administrator.

On 11 November 2025, the Local Court of Amberg ordered provisional insolvency administration for the assets of Uplifter GmbH & Co. KG and appointed attorney Mr Daniel Barth from PLUTA Rechtsanwalts GmbH as provisional administrator.

The PLUTA team has found a follow-up solution for the third location (Bavarian Forest) in the debtor-in-possession proceedings for erlebnistage gGmbH. This means that all three locations will be maintained. Solutions had already been found for the Harz Mountains and Lake Schwerin sites.

Organic artisan bakery ‘32° | Die Werkstatt für Genuss’ located at Moritzplatz in Augsburg can continue operating: provisional insolvency administrator Mr Georg Stemshorn from PLUTA Rechtsanwalts GmbH has announced that he has found a follow-up solution. Experienced bakery entrepreneur Mr André Heuck is to acquire the business of the associated operating company Panemano GmbH.

The future of the ‘An der alten Molkerei’ retirement home in Leer has been secured. Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH has found an investor in the insolvency proceedings for ESG Leer GmbH, which operates the facility. Effective 1 November 2025, Lebenshuus An der Alten Molkerei GmbH i.G. will take over the running of the retirement home and keep on all 75 employees. The parties have agreed not to disclose any details concerning the purchase agreement.

On 24 October 2025, the Local Court of Charlottenburg ordered provisional insolvency administration for the assets of Pflegewerk Berlin GmbH and appointed attorney Mr Frank Brachwitz from PLUTA Rechtsanwalts GmbH as provisional administrator. The outpatient care provider has been fully operational ever since and is continuing to provide reliable support and care to the people in need of its services.

Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has stated that the gynaecology practice in Kressbronn will also be preserved as part of the insolvency proceedings for MVZ Tettnang GmbH. Dr Maren Münster, the resident gynaecologist, will take on the healthcare centre’s statutory health insurance contract for the relevant services and continue operating the gynaecology practice at the present location in Kressbronn from January 2026.

In the insolvency proceedings for Huber Automotive AG, an investor has been secured for the development division within just five weeks. The PLUTA Management GmbH team has been responsible for the sales process. Insolvency administrator Mr Martin Mucha from law firm Grub Brugger has been conducting the process of finding an investor in consultation with the creditors’ committee.

Having already implemented an initial partial measure covering gynaecology and obstetrics services, insolvency administrator Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has now developed an overall solution for the Friedrichshafen and Tettnang healthcare centres. Sporting goods retailer Sporthaus Wohlleben GmbH has filed for insolvency. On 16 October 2025, the Local Court of Coburg ordered provisional administration for the company’s assets and appointed Mr Peter Roeger from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator.

WIPA Werkzeug- und Maschinenbau GmbH based in Stadtlohn is involved in provisional insolvency proceedings. On 1 October 2025, the Local Court of Münster ordered provisional administration and appointed attorney Dr Ria Brüninghoff from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator.

Business remains operational – restructuring options being examined

ERKA Maschinenbau GmbH based in Ahaus has filed for insolvency. On 10 October 2025, the Local Court of Münster ordered provisional insolvency proceedings and appointed Mr Stefan Meyer, a specialist attorney for insolvency and restructuring law with PLUTA Rechtsanwalts GmbH, as provisional administrator.

In the insolvency proceedings for the assets of Medizinisches Versorgungszentrum GmbH, a healthcare centre at Friedrichshafen Hospital, insolvency administrator Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has achieved an initial follow-up solution. Dr Imke Hoheisel, a specialist in gynaecology and obstetrics, will take on the healthcare centre’s statutory health insurance contract and open her own gynaecology and obstetrics practice in Friedrichshafen-Kluftern at the start of 2026.

In the insolvency proceedings of electric aircraft pioneer Lilium, insolvency administrator Ivo-Meinert Willrodt of PLUTA Rechtsanwalts GmbH has sold the company’s patents and registered intellectual property rights. The buyer of the patent portfolio is Archer Aviation Inc., an U.S. publicly listed developer of electric vertical take-off and landing aircraft (eVTOL).

Insolvency administrator Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has found a long-term solution for Munich-based Redville GmbH. An investor has acquired the business under an asset deal and will keep on all employees. The business remains fully operational and customer relationships are unaffected.

The restructuring process for Schanzer Zeitarbeit GmbH based in Ingolstadt has been successfully concluded. As part of the debtor-in-possession proceedings, the creditors have unanimously approved the insolvency plan for the personnel service provider, which is active on a supraregional scale. Schanzer Zeitarbeit has therefore been fully restructured and will continue to operate under its present structure. All 150 or so jobs have been saved. Restructuring experts Mr Ivo-Meinert Willrodt and Mr Ludwig Stern from PLUTA Rechtsanwalts GmbH have supported management as general agents during the debtor-in-possession proceedings.

Günzburg-based Sungrade Photovoltaik GmbH has filed for insolvency. Following this, on 2 October 2025, the Local Court of Neu-Ulm ordered provisional insolvency administration for the company’s assets and appointed Mr Florian Zistler from PLUTA Rechtsanwalts GmbH as provisional administrator.

Concept Maschinenbau GmbH, which acquired the business of the insolvent Kiener Maschinenbau GmbH in 2023, has initiated (provisional) debtor-in-possession insolvency proceedings before the competent court.

PALUX AG, the GUSTATUS Group’s principal company, has been able to successfully complete its debtor-in-possession proceedings. By order dated 30 September 2025, the Local Court of Crailsheim, as the competent court, ordered that the proceedings be terminated on 1 October 2025. The commercial kitchen manufacturer can therefore operate independently again and is well placed for the future.

Restructuring expert Mr Georg Jakob Stemshorn from PLUTA Rechtsanwalts GmbH has announced a successful M&A outcome in the proceedings for Scantinel Photonics GmbH: the insolvency administrator today signed a purchase agreement with an international consortium of investors based in Europe and the US.

Pechtl CNC-Frästechnik GmbH based in Böbingen intends to restructure under insolvency proceedings and has filed the relevant application. By order dated 25 September 2025, the Local Court of Aalen ordered provisional insolvency administration and appointed restructuring expert Mr Florian Zistler from PLUTA Rechtsanwalts GmbH as provisional administrator.

A long-term funding guarantee has been secured for Kreiskliniken Dillingen-Wertingen gGmbH: the Dillingen an der Donau district assembly met today and unanimously approved the financing commitment for the years 2026 and 2027. The hospital board had already unanimously voted in the past week to recommend that the district assembly approve the financing. This decision marks a major milestone in the ongoing protective shield proceedings and increases the prospects of a successful restructuring.
